Woman Sues Las Vegas Bar Over Injury on Mechanical Penis Attraction

An Illinois woman has filed a lawsuit against a downtown Las Vegas bar, alleging she was severely injured when she was thrown from a mechanical penis ride during a late-night visit.

The complaint, filed Sept. 30 in Clark County District Court against The Nerd, claims the venue failed to maintain the attraction, warn patrons of inherent hazards, or require safety waivers prior to use.

According to the filing, Amber Zabran visited the bar—located inside the Neonopolis complex at 450 Fremont St.—on Nov. 22, 2025, with friends shortly before closing time. The venue features arcade games, bowling lanes, and a bull-ride-style attraction, which is promoted online with the tagline: “Ride it, slide it, stay on top.”

Lawsuit Details

After paying for a turn, Zabran’s lawsuit states that she was not asked to sign a waiver or release and received no verbal safety instructions. The bar’s website currently states that “a waiver is required to be signed prior to riding.”

The mechanical attraction, controlled by an employee using a joystick panel, began with slow circular movements before accelerating. During operation, Zabran’s foot or ankle allegedly slipped into a cutout section beneath the main shaft of the device.

The complaint states she was subsequently thrown from the seat, causing “great pain of body and mind,” severe physical trauma, and lasting nerve damage, along with mental stress and anxiety. The filing adds that certain injuries may be permanent.

The suit argues the attraction was defective, improperly supervised, and operated in a manner that heightened the risk of a fall. It further alleges staff failed to warn patrons of inherent risks.

In addition to primary negligence, the complaint cites vicarious liability, negligent hiring, retention, and supervision, as well as res ipsa loquitur—a legal doctrine permitting plaintiffs to infer negligence from circumstantial evidence when the mechanism of injury was under the exclusive control of the defendant.

Zabran is seeking damages in excess of $15,000 for medical expenses, lost wages, and pain and suffering, alongside attorney fees.

The lawsuit names Imagine Adventures Las Vegas LLC (doing business as The Nerd), Imagine Adventures Holdings LLC, and owner-operator Jonathan Borchetta as co-defendants.

Representatives for The Nerd did not immediately respond to a request for comment.
